Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Loomlings’ websites, apps, and services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. You must be at least 18 years old and able to form a binding contract to create an account. Loomlings is intended to be operated by a parent or legal guardian on behalf of their children.

You are responsible for your account, for keeping your credentials secure, and for all activity that happens under your account. Provide accurate information and keep it up to date. Tell us promptly if you suspect any unauthorised use.

• ✦Loomlings offers paid monthly plans (currently Starter and Family) that each include a set number of stories per month. A “story” is one finished, illustrated, narrated tale, including the short collaborative voice chat used to create it.
• ✦Each plan begins with a 7-day free trial that includes one free story. A valid payment method is required to start the trial. You will not be charged during the trial, and unless you cancel before it ends, your chosen plan begins automatically at the price shown at checkout.
• ✦Your monthly stories refresh at the start of each billing period and do not roll over; unused stories are not carried forward or refunded.
• ✦Plans are billed in advance on a recurring basis and renew automatically until cancelled. You may change plans, and changes take effect as described at the time you make them.
• ✦You can cancel at any time from your account page; cancel before the trial ends and you pay nothing, and cancelling a paid plan stops future renewals while you keep access until the end of the current billing period.
• ✦Payments are processed by Braintree, a PayPal service. Prices are shown at checkout and may change with notice for future billing periods.
• ✦Except where required by law, payments are non-refundable.

You agree not to use the Service to:

• ✦Create, request, or distribute content that is unlawful, harmful, hateful, sexual, or otherwise inappropriate for children.
• ✦Attempt to bypass safety filters, the parent gate, or other protective measures.
• ✦Reverse engineer, disrupt, overload, or attempt to gain unauthorised access to the Service.
• ✦Infringe the intellectual property or privacy rights of others, or upload personal data of others without authority.
• ✦Use the Service for any commercial resale of generated content without our written permission.

We may suspend or terminate accounts that violate these Terms or put children or the Service at risk.

As between you and Loomlings, you own the stories you create through the Service. You are responsible for the prompts and details you provide. You grant us a limited licence to process, store, and display your content solely to operate and provide the Service to you (for example, generating, narrating, and saving your stories).

Loomlings and its software, branding, and underlying technology remain our property. Given the nature of generative AI, similar stories may be created for other users; you do not receive exclusive rights to themes, tropes, or styles.

The Service is provided “as is” and “as available”, without warranties of any kind to the fullest extent permitted by law. AI-generated content may occasionally contain inaccuracies; while we apply kid-safe filtering, you remain responsible for supervising your child’s use. We do not guarantee that the Service will be uninterrupted or error-free.

To the maximum extent permitted by law, Loomlings will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

We may update these Terms or the Service from time to time. If we make material changes, we’ll update the “Last updated” date and, where appropriate, notify you. You may stop using the Service at any time; we may suspend or end access if you breach these Terms or as needed to protect the Service or its users.

These Terms are governed by the laws of Andorra, without regard to conflict-of-laws rules, and the courts of Andorra will have non-exclusive jurisdiction over disputes, except where mandatory local law in your country of residence provides otherwise.
